| The travel contract below mentioned, is
regulated by the “Traveling International Convention” signed in
Brussels on April 23, 1990, which stated that all the cancellations,
changes and substitutions by reasons applicable to the traveler or
the Agency, are subject to penalty. The cancellations, changes and
substitutions of reservations made by unforeseen circumstances and
by force majeure, as the caused by phenomenon natural or social,
will be regulated by the stated in this contract. General
reservations. The reservations accepted by Peru Gateway
Travel / Orquídea Tour, will be subject to
availability of transportation, lodging and operators, which will be
informed to the traveler through a final confirmation . The
itineraries are worked very carefully with the traveler
assistance but, for operations reasons, it could be necessary to
change the order of the activities, due to force major problems,
such as natural disasters; social problems, such as strikes, etc.,
which in most cases the transport and operators of the city to be
visited are totally stopped, in this unforeseen cases, the Quality
and Control Department will make these changes, together with the
travelers and their operators. Traveler documentation
Peru Gateway travel / Orquídea tour recommend to the travelers, to
present their personal documents to show the operator and hotels
with the correct names, effective numbers in the passports, etc. in
order to avoid problems and charges of the 19% additional Peruvian
tax at the moment of the check in or out at the Hotels.
Passports & Visas You are responsible for all visas,
permits, necessary health requirements, and any other documents as
required by laws, regulations and orders of the countries visited.
All passengers travelling in South and Central America require a
Passport, valid for 6 months beyond the conclusion of their trip,
and with appropriate visas according policy of each country.
Important:
It is the responsibility of each passenger to have a valid
Passport and necessary visas, as well as to comply with entry,
health or other requirements of the countries visited. The Operators
and/or their employees and agents are not responsible for passport,
visa requirements, entry, health or other requirements of the
countries visited or for any loss sustained by you for failing to
comply with laws, regulations, orders and/or requirements of
countries visited.
Modification of reservations Any change made by the
traveler must be done within 30 labor days (individual passengers),
60 labor days (groups) prior to the travel, if not, Perú Gateway
Travel / Orquídea Tour will reserve the right to accept or decline
the modifications suggested according to availability of the
tourists companies : lodgings, tour operators and transport. The
changes in reservations is made 15 labor days prior the date of the
travel, will not be accepted.
Validity of contingencies.
There could be changes which caused several modifications, such as
taxes for airport and general tourist services. If the modifications
caused an increase of more than 10% in the agreed price, the
traveler can cancel the contract without penalty if he inform by
written to Perú Gateway Travel / Orquídea Tour during the 48 hours
of received the modification. In other way, will be considered that
the travel agree with the modification(s). Air tickets booking
Prices are subject to availability and tariff change until the date
of issue, traveler will be informed about that change. Besides that,
the schedule and flight numbers are also subject to change by the
airline until the departure date. The air reservation is emitted
immediately so it is not refundable.
The personal information that the traveler send like names, surnames
and passport numbers for the flights reservation have to be the same
as your passport document. It will be the responsibility of the
traveler in case there are some mistakes or omission.
Substitution of the traveler – Lodgings and organized tours.
The traveler who cannot made the itinerary due to personal reasons,
such as sickness, can be replaced by other person with a previous
notification of 15 labor days prior to the date of travel, this
regulation will be only possible for lodgings and tours, but not for
“Inca trail ”, air and bus tickets, which only can be used by the
original traveler, on the contrary, the new traveler must pay the
expenses of any penalty occurred by the change in the name or should
have to pay all the service again. High Season Period
During the high season from April to July Perú Gateway Travel /
Orquídea tour, will reserve the right to change the cancellation
policies, in function with the special restrictions and penalties of
the Hotels and suppliers. Inca Trail booking
The policy of cancellation of “Inca Trail” is the strictest of the
traveler contract; it depends on and is only subject to the INC
“National Institute of Culture” and the operators, who have the
authority and control of this. Perú Gateway Travel / Orquídea tour
is subordinated to the availability of the Inca Trail operator and
INC.
After the date acceptance and the payment received the service can
not suffer any modification, such as: change of date, change of
passports, substitution of passengers; cancellations due to personal
reasons, etc. Perú Gateway Travel will not make any reimbursement
for the above mentioned reasons. Any modification or cancellation
must be informed to the Quality and Control Department.
Cancellations: Organized tours and lodgings.
The request of cancellation must to be required by written to the
Quality and Control department including all the relevant
information. Take note that the package is subject for the Hotels
cancellation polices so for this reason the deadline above will be
depend of the final response from our Hotels in general. In case
exist air tickets included in the package will be not refunded that
portion.
In case a traveler of the package decided to cancel the trip for any
reason with a very few days prior the arrival and not exist the
traveler substitute Peru Gateway Travel /Orquidea tour will charge
the total price of the package in order to cover all the expenses of
the arrangements . *Cancellation Recess Package (individual
passengers),
Within the 30 labor days (Monday to Friday) prior the arrival- the
deposit of the travel must be totally reimbursed, less $ 15.00 for
administrative charges
Within the 29 and 16 labor days (Monday to Friday) prior the arrival
- we will reserve the right to keep the half of the deposit, less $
15.00 for administrative charges.
There will not be any reimbursement within the 15 labor days prior
to the arrival.
Cancellations Recess Package (GROUPS)
Within the 60 labor days prior to arrival (Monday to Friday) prior
the arrival- the deposit of the travel must be totally reimbursed,
less $ 15.00 for administrative charges
Within the 59th labor days to the 45 days (Monday to Friday) prior
the arrival- we will reserve the right to retain half of the deposit
less $ 15.00 for administrative charges.
We will be unable to make any refund from 44 working days, or less,
days prior to arrival.
The tourist transportation, such as train or bus will be subject to
the policy of their suppliers. Also, there will not be any kind of
reimbursement if the travel is cancelled due to the lack or
irregularities in the personal documents of the traveler, which
could be: identity cards, passports, vaccinations, etc.
Cancellations Recess of Hotels reservations
The cancellation of the hotels reservations can only be made via "Peru
Gateway Travel S.R.L
The request of cancellation must to be required by written to the
Quality and Control department including all the relevant
information.
The following scale of charge will be applied depending on the
season when the notification of cancellation is received.
Within the 15 labor days or more (Monday to Friday) prior to the
check-in date: US$ 15 administration charge may be made.
Within the 14 days to 9 labor days (Monday to Friday) prior to the
check-in date: 50% of the total reservation amount will be charged.
Within 8 days or less (Monday to Friday) prior to the check-in date
cannot be refunded. In case of NO-SHOW, the passenger need to pay
the 19% of IGV of the first night according peruvian regulations.
IMPORTANT NOTE: Some deluxe hotels have a different recess
cancellation so the traveler has to send the formal cancellation and
wait for the appropriate response.
Cancellation of the deposit

If the traveler request to cancel the deposit prior that Peru
Gateway travel starts with all the reservations of your package it
will be discount the $15 of the administrative expenses.
The Reimbursement

The request of the reimbursement has to be required by e-mail to the
Quality and Control department with all the relevant reason, this
process takes 15 and 20 labor days .It depends of the case. The
reimbursement is making at your credit card then in few days the
traveler need to review with your bank. Responsibility.
Perú Gateway Travel / Orquídea tour organize by order and account of
our travelers, with their names, the transportation, lodging and
other tourist services required, so we are not responsible in case
of accidents, losses of personal effects, delays or interferences
with the tour, due to force majeure like bad weather condition or
some problems in the operation respect of the transportation
companies like airplane, train and bus. We have no the direct
responsibility.
Perú Gateway Travel / Orquídea tour, are not responsible for any
kind of sickness, maternity, physical or mental impediments, which
may put into risk the health or integrity of our traveler or third
parties during the tour. We will not assume any claim or
reimbursement due to the above mentioned reasons.
We request to inform us previous to the agreement of our services,
about any limitation of this nature, in order to recommend special
services which contemplate the existing impediments. Social
Events: Perú Gateway Travel / Orquídea tour, are not responsible
for strikes or some politics situation which can be interrupt part
of your trip, in this case Peru Gateway travel does the best to try
to help the traveler and find another way you continue your trip but
it depend of the availabilities and the real situation we have to
consider the security in the zone. Quality of the services:
